On April 12, 2017, Dmitry Gavrilenko, Senior Associate at Capital Legal Services, once again spoke at the round table “Antitrust Compliance: theory and practice of application,” organized by the Antitrust Experts Association jointly with the Moscow Branch of the FAS Russia Center for Education and Methodics and Competition Law Department of the Kutafin Moscow State Law University (MSAL).

Representatives of the Federal Antitrust Service (FAS) of Russia, leading specialists of the Antitrust Experts Association, representatives of business and scientific community discussed the importance of antitrust compliance as an effective system for preventing antitrust risks and the procedure for developing and implementing it. The legislative initiatives of the Russian FAS on encouraging antitrust compliance implementation in Russia became the subject matter of the discussion.

Representatives of the Russian Ministry of Economic Development and Ministry of Justice were present among the audience.

Deputy Head of FAS of Russia Sergey Anatolievich Puzyrevsky while opening the discussion noted the main issue to be discussed pertaining to the need to form compliance systems.

Head of Legal Department of FAS of Russia Artem Vladimirovich Molchanov spoke about compliance systems in such countries as Great Britain, South Korea, Brazil and USA. Furthermore, he compared the practice of compliance abroad and the domestic practice and emphasized that currently in Russia the law does not provide norms encouraging implementation of compliance systems among the market participants.

Within the framework of the event, Dmitry Gavrilenko covered the issues related to the problem of establishing the antitrust risks. The Association member presented in his report a classification of risk assessment methods, as well as methods for internal and external risk control.

In summary, it should be noted that the members of the Antitrust Experts Association and representative of the business and scientific community openly shared their experience, challenges and success stories of implementing antitrust risk management systems that will allow the participants of the round table to adopt and use the knowledge gained for developing compliance systems in Russia and in their companies in particular.
