Pavel Kislovskiy, Senior Associate at Capital Legal Services, proposed a topic for discussion dedicated to issues of financial incentives for workers, depending on their fulfillment of KPIs established by the company. Pavel’s presentation contained not only recommendations on how to make KPIs convenient and understandable for everyone, but also possible grounds for dismissing a worker if they are not fulfilled. Pavel also spoke about possible disputable situations and arguments of the parties as to the justification for not paying bonuses based on KPIs. In the course of the discussion, the participants shared their experience of negotiating with workers on early termination of a labor contract by mutual agreement, and discussed potential disputes and their consequences in the case with disgruntled workers.
