The legislation does not allow to fight hackers effectively
People being arrested prior to a criminal case being initiated is a common event in the US court practice, Kyle Davis, Of Counsel at Capital Legal Services, agrees. Interpol can resolve to arrest a person based on a warrant issued by a US court. The availability of substantial grounds to suspect a person of a crime can also be grounds for arrest. As a rule, in such cases an FBI agent testifies under oath, attaches documentary evidence, and then the court issues a warrant, Davis says.
