CLS associates represented the interests of a chemical supplier in a dispute with a buyer who returned a quality product that was not suitable to the client and demanded a refund of its cost. The client accepted the goods for the sake of maintaining business relations with the buyer, but upon acceptance of the goods, it turned out that the products were damaged due to violation of the conditions for storing the products in the buyer's warehouse, and therefore the return of the cost of the goods to the buyer would have resulted in losses for the client.

Thanks to the legal position developed by the CLS team, we were able to achieve a complete denial of the buyer's claim and recovery of storage costs for the returned products in a counterclaim, and at the appeal stage, we were able to finally settle the dispute through an amicable agreement on favorable terms for the client, while maintaining relations with the buyer.
