Successful protection of interests of a large IT company in a dispute on infringement of exclusive rights
The CLS team represented interests of a large IT company in a dispute about infringement of exclusive rights to copyrighted objects. The copyright holder filed a claim for compensation in the amount of 5 million rubles for unlawful use of intellectual property. In justifying the amount of compensation, the copyright holder referred to lost profits due to a decrease in the number of visitors of its training courses.
During the trial, CLS associates managed to prove the disproportionality of the claimed compensation for violations committed, as well as disprove some of the plaintiff's arguments about the nature and scope of use of disputed objects. Following the review of the case, the court significantly reduced the amount of compensation to be recovered, which allowed the client to minimize financial and reputational risks.
