Protection of a contractor's interests in a major construction dispute during unilateral withdrawal of the client from the contract

CLS team represented a contractor in a series of disputes that arose after their customer’s unilateral withdrawal from construction contracts. The customer demanded a large penalty, denying the performance of part of the work and blaming the contractor for failure to meet deadlines.

CLS associates filed counterclaims to recover the cost of completed but unpaid work, penalties and the cost of materials. Thanks to a verified evidentiary strategy and work with forensic expert examination, the penalty was reduced by the court five-fold – from 33 to 6 million rubles, and in the cassation court CLS managed to change the approach to allocating expert examination costs.
